PROLINE Points Program Contest Rules

NO PURCHASE NECESSARY. CONTEST ONLY OPEN TO RESIDENTS OF ONTARIO 18 YEARS OF AGE OR OLDER WITH A VALID PROLINE POINTS ACCOUNT.

The PROLINE Points Contest (the “Contest”) is a part of the PROLINE Points Program and is sponsored by the Ontario Lottery and Gaming Corporation (“OLG” or the “Sponsor”). The Contest is managed by Splashdot (the “Contest Manager”), acting on behalf of the Sponsor for the purposes of the Contest.

The Contest commences September 5, 2023, at 12:00:00 a.m. ET and ends on August 31, 2024, at 11:59:59 p.m. ET (the “Contest Period”). The Contest is comprised of individual monthly contest periods with three separate draws each as set out in Sections 10-12 below for which Prizes are available to be won (each, a “Monthly Contest Period”).

These Contest Rules are subject to the PROLINE Points Program General Terms and Conditions which may be found here (“PROLINE Points Terms”). Capitalized terms not otherwise defined herein have the same meaning as that set out in the PROLINE Points Terms.



CONTEST ELIGIBILITY

  1. The Contest is open to participants that are, at the time of participating:
    1. Residents of Ontario;
    2. Eighteen (18) years of age or older at the time of Entry (as defined in Rule 8);
      and
    3. Have become a Member of the PROLINE Points Program (“Program”) in accordance with the PROLINE Points Terms.
  1. Notwithstanding (1), the Contest is not open to the following individuals who, at the time of participating, are:
    1. Employees of:
      1. the Sponsor, including full-time, part-time, and student employees, persons directly on the Sponsor’s payroll, and employees of the Sponsor that are on paid or unpaid leave;
      2. the Sponsor’s advertising, promotion, and Program management agencies;
      3. the Program Manager or the Program Administrator; or
      4. the Alcohol and Gaming Commission of Ontario ("AGCO");
    2. Members of OLG’s Board of Directors;
    3. Directors, officers, partners, and sole proprietors of OLG’s authorized retailers, or paid or unpaid, full-time, part-time, and student employees of OLG’s authorized retailers who are engaged in any manner in the handling of lottery tickets, including without limitation the activation, sale, validation or the redemption of lottery tickets are not eligible to participate in this Program, by themselves or as a member of a group, by way of purchasing or receiving a lottery ticket from the retailer location with which he/she is associated, and are not entitled to claim any prize resulting from their participation contrary to these Rules or contrary to any applicable policy of OLG.
    4. Individual consultants or public-sector employees retained by OLG through contracts of retainer for periods of service of thirty (30) days or more in the aggregate.
  1. An entrant who meets the requirements of both (1) and (2) above will be deemed an eligible participant (each, an “Eligible Participant” and collectively the “Eligible Participants”).
  2. In the event that an entrant does not meet the eligibility requirements set forth herein, or in the event that a previously Eligible Participant no longer meets the eligibility requirements set forth herein, as determined by the Sponsor, Program Manager and Program Administrator in their sole and absolute discretion, then such participant shall be disqualified and there shall be no obligation to award any Prizes to such entrant.
  3. The Contest takes place in Ontario, Canada.

ODDS

  1. The odds of winning any Prize set out in Section 12, Figure 1 is dependent on the number of all eligible Entries received for each Draw (defined below) during each Monthly Contest Period.

HOW TO ENTER

  1. NO PURCHASE NECESSARY. Eligible Participants must have a PROLINE Points Program Account in order to participate in the Contest. If an Eligible Participant does not have a PROLINE Points Program Account, the Eligible Participant must visit https://prolinepoints.olg.ca (“Site”) and follow the instructions for sign-up. Accounts are free to obtain.
  2. There are two ways to enter this Contest:
    1. Points Redemption: Eligible Participants can redeem their earned Points as part of the Program for Entries as follows:
      1. During any Monthly Contest Period, Eligible Participants must log into their PROLINE Reward Program Account on the Site, click on the “Prizes” link and follow the steps outlined below.
      2. 25 Points required for (1) Entry. Eligible Participants can redeem 25 Points to obtain one (1) Entry into a given Draw. Additional Entries can be obtained by redeeming further multiples of 25 Points within the same Monthly Contest Period. By way of illustration only, an Eligible Participant who redeems 125 Points during a Monthly Contest Period would receive a total of five (5) Entries that can be allocated toward any available Draw in accordance with Section 8(a)(iii). Point totals will not be rounded up, i.e. 116 points would entitle an Eligible Entrant to 4 Entries total. A minimum of 25 Points must be in the player’s Account balance to obtain any single Entry.
      3. There are three (3) draws available in any Monthly Contest Period with its own prizing as set out below (each, a “Draw” or “Monthly Prize Draw”). Entries can be allocated across any of the 3 available Draws. By way of illustration only, if a Member wishes to redeem 75 points for 3 Entries, he or she may allocate 1 Entry per available Draw. Alternatively, the Member may allocate all 3 Entries into a single Draw. After an allocation has been made, it cannot be undone. There is no limit on the number of Entries per Member.

    2. No Purchase Necessary (“NPN”) Entry Option: To receive one (1) Entry without making a purchase clearly print, during the Contest Period, type or handwrite your first name, last name, full address (Street, Apt./Suite, City/Town, Province, Postal Code), email address, day and evening telephone numbers, date of birth, and a hand-drawn facsimile of the PROLINE logo along with the words “I agree to the PROLINE Points Program Rules and Regulations” clearly on one (1) page of 8 ½” x 11” paper (letter-size), and mail it to PROLINE Points Program, 70 Foster Drive, Suite 800. Sault Ste. Marie, ON P6A 6V2. For each unique NPN Entry received by OLG during a given Monthly Contest Period, OLG will provide an online code to the Eligible Participant that can be entered into the Site to earn one (1) Entry into one of the current Monthly Prize Draws. Requests must be received no later than (7) days before the end of a given Monthly Contest Period.

      The email address provided in the letter must match the Eligible Participant’s Account email address. OLG is not responsible for delayed or non-delivery of an online code prior to the close of a contest.

      A limit of one (1) Entry will be provided per unique NPN Entry received per Monthly Contest Period. NPN Entries may take up to 5 business days from receipt to be processed by the Program Administrator. NPN Entries can be allocated by Eligible Participants to any of the three Draws in a Monthly Contest Period in the same manner as described in Section 8(a)(iii).

PRIZES

  1. There are at minimum, 3 prizes available to be won for each of the 3 Draws in each Monthly Contest Period as set out in Figure 1 below (each, a “Prize”). Approximate retail values for each Prize are as set out in Figure 1.

PRIZE DRAWS

  1. Monthly Prize Draws will occur according to the Figure 1 table for each Monthly Contest Period.
  2. Entries must be assigned to any of the three Draws active in a given Monthly Contest Period.
  3. Winning Entries in any Draw will be selected by random draw during each of the Monthly Contest Periods provided below (see chart) from among all eligible Entries submitted and received in accordance with these Rules during the applicable Monthly Contest Period. Additionally, five (5) alternate draw entries (“back-up entries”), will be randomly selected to be used, in the order they were drawn, for each Monthly Prize Draw, in the event that a winning entry initially drawn, and/or one or more of the back-up entries do not qualify as per the Program eligibility requirements. Participants are eligible to win more than one (1) prize within the Contest Period. OLG is under no obligation to re-draw for unclaimed prizes. Prizes may be subject to third party terms, including as set out below. Draws will be conducted and prizes awarded as follows:

  1. Attempts will be made by the Program Administrator to contact each Eligible Participant who submitted a winning Entry (the “Potential Winner”). The Potential Winner will be contacted at the email address provided with his/her registration information. The Potential Winner must return any message sent by the Program Administrator within the 5 business days from when the message was sent or the timeframe stipulated in the message to remain eligible to receive the Prize. Prize-claiming details will be provided at the time of contact. It remains the responsibility of the Eligible Participant to ensure the contact information entered at the registration process is accurate as of the date of contact. OLG, the Program Administrator, and the Program Manager will not be responsible for any inaccurate or outdated contact information.
  2. If, within 5 business days of the first attempt to contact, the Potential Winner has not confirmed the respective Prize or is otherwise found to be ineligible to receive the Prize, the Potential Winner’s Entry will be deemed invalid and the Potential Winner will be disqualified from winning any Prize. The back-up Entries will be utilized according to the order in which they were drawn (in the event that one or more back-up Entries are ineligible), and the process will continue until such time as a winner is declared or until there are no remaining Entries to select from.
  3. Prior to being confirmed as a winner, a selected Potential Winner will be required to correctly answer a mathematical skill-testing question without mechanical or other aid. Without limiting the generality of the forgoing, the Released Parties (as defined below in Rule 18) reserve the right, in their sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
  4. Eligible Participants acknowledge that the Sponsor and all involved advertising and promotional agencies, the Program Manager, Program Administrator, the AGCO, the Prize Supplier and other suppliers providing Prizes or other materials or services in connection with this Program, anyone else involved in the development or execution of this Program, each of their respective parent companies, subsidiaries and affiliated companies and each of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (the “Released Parties”) are not responsible in any manner whatsoever for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize(s), including but not limited to, its quality, merchantability and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority. In no event will the Released Parties be collectively liable for more than the approximate Prize amount.
  5. The winner of the Program, in advance of receiving his or her Prize, will be required to sign a Standard Declaration and Release confirming eligibility, compliance with these Rules, and releasing OLG, Splashdot, and their respective employees, affiliates and subsidiaries, franchisees, authorized retailers, agents, contractors, representatives, advertising, promotion and Program management agencies, and any independent judging organization from any liability, claims, damages and/or responsibility in connection with the conduct of this Program or the awarding or use of any Prize(s).
  6. Eligible Participants agree that a photo or video, name, and residence (town or city only) of prize winners may be posted, published, or announced on the Program website, the OLG website and/or other media or social media for up to twenty-four (24) months after the selected Potential Winner is confirmed as a winner, and that they will receive no compensation for such posting, publication, or announcement.
  7. If no winner is declared for any Prize, that Prize will not be awarded.

PERSONAL INFORMATION

  1. Any personal information collected by OLG or on OLG’s behalf by the Program Manager and/or Program Administrator, including but not limited to Entrants’ contact information, is collected pursuant to section 3 of the Ontario Lottery and Gaming Corporation Act, 1999 and is intended to be used for the following purposes: to conduct and administer the Program by OLG or through a Program Manager or Program Administrator, including but not limited to contacting entrants, validating eligibility and the awarding of the Prize(s); marketing and advertising purposes including providing individuals with information or services they have opted in to receive, understanding their interests, responding to their concerns and improving service delivery; for OLG's internal business purposes and to comply with legal requirements. GENERAL

  1. Prizes must be accepted as awarded. No substitutions, assignments, or transfers of prizes permitted, except at the Sponsor’s sole and absolute discretion. Unclaimed prizes will not be awarded.
  2. The Sponsor and/or Program Manager reserves the right to terminate, modify or withdraw this Program, in whole or in part (including altering the manner in which the Prizes are distributed and whether certain Prizes will be awarded), at any time and for any reason without prior notice, including without limitation Program Termination, and to disqualify any individual who tampers with the Entry process, violates these Rules, or acts in a disruptive manner. Without limiting the foregoing, the Sponsor and/or Program Manager may lock out any entrant who, in the Sponsor’s or the Program Manager’s sole judgment, has been disqualified, has questionable eligibility, or is otherwise ineligible to enter the Program. Without limiting the foregoing, the Sponsor and/or Program Manager reserves the right to alter any of the time frames, number and value of Prizes, and any other aspect associated with this Program.
  3. BY SUBMITTING AN ENTRY, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY SUBMITTING AN ENTRY, YOU ALSO AGREE THAT THE ENTRY COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY; (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED THE WINNER, ANY PRIZE (INCLUDING ANY USE OR MISUSE OF ANY PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE
  4. Third Party Terms. Eligible Participants understand and acknowledge that each component of the Prize and the use thereof may be subject to a separate set of third-party terms and conditions, including but not limited to rules, regulations, restrictions, terms and conditions indicated on any tickets associated with the Prize, in force at the venue hosting each event, and any health and safety polices or protocols associated with any of the foregoing (e.g., COVID-19 testing requirements, vaccination requirements and proof, social distancing requirements, requirements for face coverings, etc.) (“Third Party Terms”). The Eligible Winner is responsible for determining the Third Party Terms applicable to the Prize (or component thereof) and their use thereof and hereby agrees to comply with such applicable Third Party Terms. OLG does not make and expressly disclaims any representations or warranties with respect to any Prize component and expressly disclaims any responsibility or liability to a winner for any Prize component. The winner and guest (as applicable) are solely responsible for complying with Third Party Prize Terms; failure to do so may result in forfeiture of the Prize.
  5. These Rules are subject to change (including, but not limited to, changing the value and number of Prizes, the Program dates and times, or the draw dates and times) in the sole and absolute discretion of the Sponsor and/or Program Manager, and an Eligible Participant’s continued participation in this Program signifies the acceptance of the revised Rules.
  6. Any individual who attempts to undermine the legitimate operation of this Contest may be subject to civil and/or criminal penalties and fines. The Sponsor and Program Manager reserve the right to seek damages, whether direct or consequential, from any such individual to the fullest extent permitted by law.
  7. The Sponsor, Program Administrator and the Program Manager assume no responsibility for: (i) Entries lost, stolen, delayed, damaged or misdirected; (ii) for the failure, interruption or delay of any mail or email or other communication to be received, for any reason; (iii) any computer viruses, time bombs, logic bombs and any other implanted devices of a like or similar nature that may arise or occur in connection with the Program; (iv) problems with the function of any website or website feature howsoever caused; (v) the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data or software, online systems, servers or access providers; (vi) any functionality lost due to not having cookies enabled; traffic congestion on the Internet; (vii) the security or privacy of information transmitted via computer networks; (viii) for breaches of privacy due to interference by third party computer “hackers”; or (ix) any combination thereof, as a result of participation in this Program.
  8. Entries that have been obtained or made through fraudulent means are subject to disqualification. The Sponsor, Program Administrator, and Program Manager will not be responsible for Entries that are lost, misdirected, or delayed for any reason whatsoever. An entrant is only allowed to register for a Program Account once. More than one registration will invalidate ALL Entries submitted by the person who created the duplicate accounts and each such account will be disqualified. None of the accounts deemed, in the Program Manager’s sole discretion, to have been entered by this person will be eligible to win ANY Prize. Once registered, only an entrant’s email address and password will be required when visiting https://prolinepoints.olg.ca.
  9. It is expressly understood and agreed by all entrants that OLG and Splashdot do not accept responsibility, in whole or in part, for loss, damage or injury, whether direct or indirect, howsoever caused in connection with any Prize or the conduct of the Program.
  10. With respect to this Program, all decisions of the Program Manager, Program Administrator, and Sponsor are final and binding with no right of appeal.
  11. If the identity of an entrant is disputed, the authorized account holder of the email address submitted with the Entry in question will be deemed to be the Eligible Participant for the purposes of the Program. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A Potential Winner may be required to provide proof that they are the authorized account holder of the email address associated with the Entry in question and is otherwise required to meet all eligibility requirements set out in these Rules. Failure to do so may result in disqualification in the sole and absolute discretion of the Program Manager and/or the Sponsor.
  12. In the event of any conflict with any provisions contained in these Rules and details contained in any form of related promotional material or media (the “Program Materials”), these Rules shall prevail.
  13. Draw dates and times are subject to change without notice.
  14. All winning Entries for the Program will be destroyed by the Program Manager on or after three (3) years from the corresponding draw date, with all other Entries for the Program being destroyed by the Program Manager on or after two (2) years from the corresponding draw date.
  15. This Program is subject to the laws of the Province of Ontario and the Federal laws of Canada as applicable.
  16. These Rules govern this Program and must be complied with. By agreeing to participate in the Program, all entrants agree to comply with and be bound by these Rules.
  17. The insertion of subheadings in these Rules are for convenience and reference purposes only and will not affect the construction or interpretation of these Rules. All sums of money that are referred to in these Rules are expressed in the lawful money of Canada. References to “discretion”, “sole discretion”, or “solely” mean the absolute, sole, unqualified, subjective discretion of the party having or exercising such discretion. In the event any part of these Rules is found to be void or unenforceable by a court of competent jurisdiction, the remainder of these Rules shall operate to the fullest extent permissible by law.
  18. The Sponsor may, in its sole and absolute discretion, extend this Program for any reason it deems appropriate. This includes, but is not limited to, satisfying promotional integrity issues, and technical errors or issues.
  19. All times and dates refer to Eastern Time ("ET").
